Beverly Hills-based Alan Gutman has written to Dr Pepper Snapple Group Inc. president and CEO Larry Young, accusing the company of operating an online redemption scheme that was an “unmitigated disaster which defrauded customers.” Gutman is demanding that Dr Pepper makes good on its offer by extending the period for the offer; he also wants full-page apologies in The New York Times, Los Angeles Times, USA Today and The Wall Street Journal.

Gutman’s letter makes clear his view that the original campaign was an “exploitation of my clients’ legendary reputation and their eagerly awaited album” and “brazenly violated our clients’ rights.” He is also seeking an “appropriate payment… for the unauthorized use and abuse of their publicity and intellectual property rights,” with the threat of further action if an acceptable offer is not made.

“Now is the time to clean up the mess,” says Gutman.

The group recently also announced an interesting interactive fan contest to receive a lifetime V.I.P. lamanent. All you have to do is go to the site and follow the clues…and of course buy the album.

This Sunday saw the first signs of your prayers in action. Chi was able to hear and respond to his father’s request to move his lower lip. His father also administered a tendon reflex test, of which both legs responded with movement. Doctors continue to remain optimistic, and the energy at the hospital remains very positive.

The family would also like to send a special thank you out to the three off duty EMTs that stopped shortly after the accident and saved Chi’s life. It was by the Grace of God that these three individuals happened to be traveling on the road with medical gear in tow at the time of the accident. If not for them, the chances of Chi making to the hospital alive would have been poor.
